1. Agreement to Terms

By accessing or using fumbl ("Service"), operated by fumbl ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access the Service, including the web application at app.fumbl.io and the marketing site at fumbl.io.

2. Account Terms

  • You must be at least 16 years old to use this Service.
  • You must provide a valid email address and accurate information to create an account.
  • You are responsible for maintaining the security of your account credentials. We recommend using a strong, unique password.
  • You are responsible for all activity that occurs under your account.
  • You may not use the Service for any illegal or unauthorized purpose.
  • One person or legal entity may maintain no more than one free account.

3. Acceptable Use

You agree not to use fumbl to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Generate spam, phishing content, or deceptive material
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation
  • Attempt to circumvent usage limits, generation quotas, or other technical restrictions
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use automated tools (bots, scrapers) to access the Service beyond our documented API
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

4. Content Ownership

Your Content

You retain full ownership of all content you submit to fumbl for repurposing ("Input Content"). You also retain full ownership of all content generated by the Service based on your Input Content ("Output Content").

By submitting Input Content, you grant us a limited, non-exclusive license to process your content through our AI pipeline solely for the purpose of providing the Service to you. We do not claim any ownership rights over your Input or Output Content.

Our Content

The Service, including its design, features, documentation, and branding, is owned by fumbl and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

AI-Generated Content

Output Content is generated by AI (Anthropic's Claude) based on your Input Content. While we strive for high-quality results, AI-generated content may contain errors, inaccuracies, or require editing. You are responsible for reviewing and verifying all Output Content before publishing.

5. Subscription and Billing

Plans and Pricing

fumbl offers multiple subscription plans (Free, Creator, Pro, Agency) with varying features and generation limits. Current pricing is available at fumbl.io/pricing. We reserve the right to change pricing with 30 days' notice to active subscribers.

Billing Cycle

Paid subscriptions are billed monthly. Your billing cycle begins on the date you subscribe and renews automatically each month. Generation allowances reset at the start of each billing cycle.

Pay-Per-Use Credits

When you exceed your plan's monthly generation limit, you may purchase additional credits at $0.50 per generation. Credits are non-refundable and do not expire.

Cancellation

You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of your current billing cycle. You will retain access to paid features until your subscription period ends.

Refunds

We offer a 14-day money-back guarantee on all paid plans. If you are not satisfied within 14 days of subscribing, contact us for a full refund. After 14 days, subscription payments are non-refundable. Credit purchases are non-refundable at any time.

6. Service Availability

We strive to keep fumbl available 24/7 but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance in advance.

7. API Access

API access is available to Pro and Agency plan subscribers. API usage is subject to the same generation limits as the web application. You must keep your API keys confidential and are responsible for all activity performed with your keys. We reserve the right to revoke API access if it is misused.

8. Limitation of Liability

To the maximum extent permitted by law, fumbl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

Our total liability for any claims arising from or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

We are not responsible for any decisions you make based on AI-generated content, or for any consequences of publishing Output Content without proper review.

9. Indemnification

You agree to indemnify and hold harmless fumbl and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination:

  • Your right to access the Service will cease immediately
  • We may delete your account data within 30 days
  • Outstanding payment obligations remain due
  • Sections 4, 8, 9, and 11 survive termination

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email and by posting a notice on the Service at least 30 days before changes take effect. Your continued use of the Service after changes are effective constitutes your acceptance of the revised Terms.
